Procedure 07: Register the Notary Office

Order or execution

 

Step 1: After the Notary Office receives the Decision for establishment, it shall prepare an application for operation registration, prepare documents and submit them at the Division of Receiving and Returning Results of administrative procedures (One – Stop Division) – Hanoi City Department of Justice.

 

 

Step 2: An officer receives and inspects the documents as submitted:

 

+ If the documents are submitted in full as stipulated, receive and issue a return note.

 

+ If the documents are not submitted in full as stipulated, guide the office to supplement and complete documents as stipulated.

 

+ If the documents are not under the jurisdiction of the Department, guide the office to the competent agency as stipulated.

 

Step 3: An one – stop officer inputs the documents into the book and transfers them to the Judicial Support Division for solving as stipulated.

 

Step 4: The Judicial Support Division receives, inspects and handles the documents as stipulated.

 

+ Where any issue to be certified arises in the course of settlement, notify the One – Stop Division of giving a notice to the organization or re-notifying time for returning results.

 

Step 5: After results are available, the Judicial Support Division transfers them to the One- Stop Division to provide results to the office according to the return note

 

Methods of implementation

 

Method 1: Documents are submitted directly to the Division of Receiving and Returning Results of administrative documents (One – Stop Division) – Hanoi City Department of Justice.

 

Method 2: Documents are submitted via the post system together with fees as stipulated.

 

Note: Documents to be submitted shall be verified under the regulations of the law.

Composition of documents

 

1. Application for registering operations of the Notary Office in the form TP-CC-09 issued together with Circular No. 06/2015/TT-BTP;

 

2. Vocational liabilities insurance contract (for each notary public working in the Office);

 

3. Documents for registering practice and issuing a card of a notary public in respect to partnership; notary public working under the labor contract in the Office (if any);

 

4. Documents used for proving head office of the Notary Office in conformity with contents as mentioned in the plan of establishment.

In the case of refusal, People’s Committee of the City gives a written notice specifying reasons for such refusal. The applicant can make a claim in accordance with laws.

Requirements, conditions of implementation

 

1. The Notary Office shall register its operations within 90 working days after receiving the Decision for establishment.

 

2. The Notary Office posts contents for its name, head office, full name, number of the decision of the notary public; number, date of issuing Operation Registration Certificate, registered operation location in the central newspaper or local newspaper within 03 consecutive issues within 30 working days after the Operation Registration Certificate is issued.

3. Circular No. 54/2015/TT-BTC dated April 21, 2015 of Ministry of Finance stipulating collection of fees for consideration of appointing a notary public; fees for granting a notary public’s card and operation registration certificate for a notary office.
