Procedure 08: Change Operation Registration Certificate of the Notary Office

Order or execution

 

Step 1: When the Notary Office changes its name, location of head office, Director or list of notaries public, it shall submit documents at the Division of Receiving and Returning Results of administrative procedures (One – Stop Division) – Hanoi City Department of Justice.

Step 2: An officer receives and inspects the documents as submitted:

+ If the documents are submitted in full as stipulated, receive and issue a return note.

+ If the documents are not submitted in full as stipulated, guide the office to supplement and complete documents as stipulated.

+ If the documents are not under the jurisdiction of the Department, guide the office to the competent agency as stipulated.

Step 3: An one – stop officer inputs the documents into the book and transfers them to the Judicial Support Division for solving as stipulated.

Step 4: The Judicial Support Division receives, inspects and handles the documents as stipulated.

+ Where any issue to be certified arises in the course of settlement, notify the One – Stop Division of giving a notice to the organization or re-notifying time for returning results.

Step 5: After results are available, the Judicial Support Division transfers them to the One- Stop Division to provide results to the office according to the return note

 

Methods of implementation

Method 1: Documents are submitted directly to the Division of Receiving and Returning Results of administrative documents (One – Stop Division) – Hanoi City Department of Justice.

Method 2: Documents are submitted via the post system together with fees as stipulated.

Note: Documents to be submitted shall be verified under the regulations of the law.

Composition of documents

1. Request for changing contents of Operation Registration Certificate of the Notary Office in the form TP-CC-10 issued together with Circular No. 06/2015/TT-BTP;

2. Original of Operation Registration Certificate of the Notary Office;

3. Minutes of meetings of members in respect to partnership;

4. Based on contents registered for change, some following documents can be further submitted:

- For changing the name:

Minutes of meeting of members in partnership of the Notary Office specifying an agreement on changing name of the Notary Office (Not coincide with or mislead with names of other notary offices, not violate traditions of history, culture, morality and customers of the country).

- For changing head office:

+ Documents used for proving head office; if the head office of the Notary Office is changed to a place in another district, a written agreement of the People’s Committee of the City as stipulated in clause 1, Article 24 of Notarization Law shall be submitted.

- For changing Director of the Notary Office:

+   Minutes of meeting of members in partnership of the Notary Office specifying an agreement for appointing a Director and expected name of the Notary Office;

+ Documents used for proving the notary public expected to act as a Director acting in the notarization practice fro 02 years or more.

- For changing the list of notaries public;

+ Written agreement for termination of membership of the notary public, written liquidation of labor contact with the notary public working under the labor contract; documents used for proving that the notary public of the Notary Office dies or is declared to die by a Court (together with notary public’s card);

+ Decision on appointment of the notary public, notary public’s card (if any); documents used for proving residence of additional notary public of the Office;

+ Commitment of the Notary Office for purchasing the vocational liabilities insurance contract for additional notary public of the Office;

      - Other documents relating to other changes.

The Notary Office has registered its operations in Hanoi City when it changes its name; head office, Director; list of notaries public.

 

Implementing agency

           - The agency competent to decide: Hanoi City Department of Justice

- The agency implementing directly: Judicial Support Division

 

Results of implementation

- Operation Registration Certificate of the Notary Office as re-issued;

- Operation Registration Certificate of the Notary Office as changed (noted);

In the case of refusal, the Department of Justice shall give a written answer specifying reasons for such refusal. The Notary Office has right to make a claim as stipulated.

Requirements, conditions of implementation

If the Operation Registration Certificate is re-issued, the Notary Public shall post contents of Operation registration certificate on a newspaper as stipulated in clause 1, article 26 of Notarization Law.

2. Circular No 06/2015/TT-BTP dated June 15, 2015 of Ministry of Justice detailing and guiding implementation of some articles of Notarization Law.

3. Circular No. 54/2015/TT-BTC dated April 21, 2015 of Ministry of Finance stipulating collection of fees for consideration of appointing a notary public; fees for granting a notary public’s card and operation registration certificate for a notary office.
